THESE TERMS CONTAIN VARIOUS LIMITATIONS AND EXCLUSIONS OF LIABILITY IN SECTION 6 AND AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER IN USA STRONG’S ADDITIONAL TERMS AND CONDITIONS.
By agreeing to the agreement, you agree to resolve all disputes through binding individual arbitration, which means that you waive any right to have those disputes decided by a judge or jury, and that you waive your right to participate in class actions, class arbitrations, or representative actions. USA Strong’s Additional Terms and Conditions also contain a release of certain claims against USA Strong and certain third parties.
What is USA Strong?
USA Strong provides a venue for buyers to discover 100% USA Made products from a diverse group of sellers. Third Party Products and USA Strong Products are sold on the Site. “Third Party Products” means items sold through our Services by third parties. “USA Strong Products” means items sold through our Services by USA Strong. “Products” refers to both Third Party Products and USA Strong Products.
How does USA Strong help sellers and buyers buy and sell Third Party Products?
USA Strong is not a part of the transaction for Third Party Products. When buying Third Party Products, You are not buying directly from USA Strong, but from one of USA Strong’s sellers. Notwithstanding the verification process described elsewhere on the Site, USA Strong does not pre-screen sellers and therefore does not guarantee or endorse any items sold on USA Strong or any content posted by sellers (such as photographs or language used in listings). Each seller on USA Strong has their own unique listings, processing times and shipping methods.
What should I do before placing an order on the Site?
Read the Product description and shipping details carefully before placing an order. We are not able to make changes to your order once it has been submitted.
What forms of payment does USA Strong accept?
USA Strong accepts the following forms of payment: Visa, Mastercard, American Express, JCB, Discover, Diners Club, and Elo. We also accept payments that are, at the time of your order, on Coinbase and GloBee’s platforms, including, without limitation, Bitcoin, Ethereum, Litecoin, Dogecoin and Bitcoin Cash.
What happens if my payment method is declined? What do you do with my payment information?
If your payment method was declined, you may have entered your information incorrectly or there may be other issues with the card like a passed expiration date or insufficient funds. Please try a new payment method and contact your financial institution for more information if you continue to experience difficulties with your payment. If the credit card issuer does not authorize payment to us for any reason, we are not liable for any delay or non-delivery of your order. You represent and warrant that you have the legal right to use any payment method you provide in connection with your order. By submitting your payment information, you authorize us, and any third party collecting this information on our behalf, to provide your information to third parties to facilitate your requested transaction.
When will I be charged for my order?
When you place an order, your card is authorized (not charged). This ensures the funds for the order are available while your order prepares to ship. You will be charged when your order, or a portion of your order, has shipped. You will only be charged for the items that are shipped, along with applicable shipping fees. You are responsible for paying all fees that you owe to USA Strong, including any applicable taxes for purchases you make through our Services.
Why was my order cancelled?
Order fulfillment is subject to product availability. The inclusion of a product on our Site does not mean that such product is or will be available for purchase through our Site or through any retail or wholesale distributor. If your order is canceled for any reason, the authorization will automatically be removed in 5-7 business days. The exact timeframe for removal is determined by your card's issuing bank.
How do I make changes to my order?
We start working on your order promptly after it is placed, and we are not able to make changes to your order once it has been submitted. Please provide accurate information (including shipping information) when placing your order.
Can USA Strong make changes to, cancel, or refuse to fulfill my order(s)?
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order including without limitation orders placed under the same customer account, credit card or using the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by email or billing contact information provided when the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate ordering and account information for all purchases you wish to make on the Site. You agree to promptly update your account and other necessary information so that we can complete your order and contact you as needed.
Can USA Strong change the prices of the Product(s)?
All prices shown on the Site are in U.S. Dollars. We reserve the right to change prices at any time without notice to you, provided that any changes made after your order is submitted will not apply retroactively.
Do I have to pay sales taxes and any other taxes on my order(s)?
All prices shown on the Site are exclusive of applicable sales tax. The amount of tax charged on your order will depend on the item purchased and the destination of the shipment. Certain items may be exempt from sales tax, depending on state and local laws. We will attempt to collect applicable taxes where we’ve determined we have a duty to. We are not required to, and do not, collect taxes in all states. You may have a duty to directly report and pay taxes if we do not collect such taxes. You understand that you are ultimately responsible for any use, ad valorem, and other applicable taxes and fees related to your purchase.
Can I leave a review of a seller’s Product(s)?
Reviews help customers learn about a seller’s Products, help good sellers build a strong reputation, and help customers warn other customers about a poor experience. You can leave a review, including a one to five star rating, for Products purchased through the Site. Your review and profile information will be publicly displayed on the seller's listing and review pages.
What kind of information can my review include?
By leaving a review, you acknowledge that the review will not: contain private information; contain obscene, racist, or harassing language or imagery; contain prohibited medical drug claims; contain advertising or spam; be about things outside the seller’s control, such as a shipping carrier, USA Strong, or a third party; contain threats or extortion; include shilling or otherwise falsely inflate a shop’s review score; or undermine the integrity of USA Strong’s review system.
Can USA Strong remove my review(s)?
What warranties does USA Strong make regarding information posted on the Site?
We endeavor to present all information on the Site accurately, however, we do not warrant or guarantee accuracy, and we are not responsible if product descriptions, specifications, or pricing on our Site is not complete, accurate, reliable, current or error-free. If you become aware of an error, please call it to our attention by contacting USA Strong at firstname.lastname@example.org.
What warranties does USA Strong make regarding the Products?
While USA Strong uses reasonable efforts to verify that all Products available for purchase on the Site are 100% USA Made, USA Strong makes no representations or warranties regarding such Products, including as to their origin, manufacture, quality, or fitness for a particular purpose.
Does USA Strong make specific warranties related to Third Party Products?
USA Strong does not manufacture, store, or inspect any Third Party Products. We provide the venue; the Third Party Products in our marketplaces are produced, listed, and sold directly by independent sellers. USA Strong does not make any warranties about their quality, safety, or legality. Any legal claim related to a Third Party Product you purchase must be brought directly against the seller of the Third Party Product.
Does USA Strong make specific warranties related to USA Strong Products?
A STRONG PRODUCTS ARE PROVIDED TO YOU “AS IS” AND WITHOUT ANY KIND OF WARRANTY (EXPRESS OR IMPLIED). WE ARE EXPRESSLY DISCLAIMING ANY WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.
Is USA Strong liable for damages in connection with the Products?
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER USA STRONG, OUR LICENSORS NOR OUR OR THEIR RESPECTIVE EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS (OUR “REPRESENTATIVES”) SHALL BE LIABLE TO YOU FOR ANY LOST PROFITS OR REVENUES, OR FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PRODUCTS OR THESE TERMS OF SALE. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL USA STRONG’S OR ITS REPRESENTATIVES’ AGGREGATE LIABILITY FOR ANY DAMAGES EXCEED THE GREATER OF ONE HUNDRED ($100) US DOLLARS (USD). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
